Welcome to DiscoverArt. These terms keep things fair and clear for everyone. By using discoverart.com, you agree to them.
1. Agreement to these terms
By accessing or using DiscoverArt (the "Service"), you agree to be bound by these Terms of Use and our Privacy Policy and Cookie Policy. If you don’t agree, please don’t use the Service.
2. Who may use DiscoverArt
You must be at least 13 years old to use the Service. If you create an account, you confirm that the information you provide is accurate and that you’ll keep it up to date.
3. Your account
You’re responsible for your account and for keeping your password secure. Let us know right away if you believe your account has been accessed without your permission. We may suspend or close accounts that violate these terms or our Community Guidelines.
4. Your content
DiscoverArt lets you post comments and perspectives about artworks and artists. You own what you write. By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and share your contributions on the Service (that’s what makes them visible to other visitors).
You’re responsible for what you post. Contributions must follow our Community Guidelines — in short: real perspectives, no spam, no harassment, no unlawful content. We may remove content that violates them.
5. Acceptable use
- Don’t use the Service for anything unlawful.
- Don’t impersonate others or misrepresent your affiliation.
- Don’t spam, scrape abusively, probe, or disrupt the Service.
- Don’t attempt to access accounts or data that aren’t yours.
6. Artwork and images
The artworks on DiscoverArt are historical works displayed via museum open-access programs and public-domain sources, with attribution to the holding institution where known. The underlying works are in the public domain; images are served courtesy of their source institutions or public-domain repositories.
If you are a rights holder and believe an image is displayed in error, contact us at info@discoverart.com and we will review and respond promptly, including removal where appropriate.
7. Our platform
The Service itself — including our software, design, taste engine, and original text — belongs to DiscoverArt. We grant you a limited, personal, non-transferable license to use the Service as intended. Please don’t copy, resell, or build competing datasets from it.
8. Third-party links
The Service links out to museums, ticketing pages, and other third-party sites. We’re not responsible for their content or practices — their terms govern your use of their sites.
9. Termination
You can stop using DiscoverArt at any time, and you can delete your account from your account page or by writing to us. We may suspend or terminate access for violations of these terms. Sections that by their nature should survive (like ownership and liability limits) survive termination.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. Artwork metadata (dates, attributions, display locations) comes from source institutions and may contain errors; always confirm details with the museum before making travel plans.
11. Limitation of liability
To the maximum extent permitted by law, DiscoverArt will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the greater of $100 or the amount you paid us in the past twelve months.
12. Changes to these terms
We may update these terms as the Service evolves. If we make material changes, we’ll post the updated terms here with a new "last updated" date, and where appropriate, notify account holders by email. Continuing to use the Service after changes take effect means you accept them.
13. Governing law
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles.
